A woman accused of pushing her 3-year-old nephew off Chicago’s Navy Pier and watching her drown in Lake Michigan has been charged with murder after the child’s death.
Last month, 34-year-old Victoria Moreno was arrested. She was initially charged with attempted first-degree murder and assaulting a child under the age of 13, but she was upgraded to first-degree murder, according to Fox 32 Chicago.
Moreno pushed Josiah Brown off Navy Pier on the afternoon of Sept. 19, according to Chicago police.
Cook County prosecutors said divers were called to the scene and pulled the infant out of the lake about 30 minutes later. He was taken to Lurie Children’s Hospital in serious condition.

In bonded court on Tuesday, Moreno’s attorney argued that Moreno didn’t intentionally push Brown into the water, but was standing over the toddler when he fell. has been diagnosed with depression and bipolar disorder.

A judge found Moreno “dangerous to the community” and ordered him to be held without bail.
