Five police officers in western Maryland will not be charged in the case in which a Virginia man died days after being shocked with a stun gun during an altercation, officials said Monday.
Frederick Police announced that 23-year-old Daniel Michael Holly died in hospital on November 14. It was two days after he used a stun gun to subdue him. The chief coroner’s office is trying to determine the exact cause of Holly’s death, but the report ruled out police actions as the cause, officials said.
The Attorney General’s Office investigated the incident, but initial reports from the agency’s independent investigative division did nothing to make officials believe there was a basis for prosecution, said Frederick County State Attorney Charlie. Smith said.

Officers were called to the home due to a report of a person acting unusually and found Holly naked, walking around and talking incoherently, police said. It was showing an officer using a stun gun after Holly tackled another officer.
